HomeMy WebLinkAbout0779 • ~ ~ 25~'725 ~ i ~ i MORTGAGE MODIFICATION AGREEMENT ~ THIS AGREEMENT, made this ~ day of May, 1973, by and ~ between FIRST FEDERAL SAVINGS AND LOAN.ASSOCIATION OF FORT ; PIERCE, a corporation organi2ed and existing under the laws of ~ ~ the United States of America, as party of the first part, and hereinafter referred to as "Association", and GULF-ATLANTIC INVESTMENTS OF FORT PIERCE, INC., a Florida corporation, as party of the second part, hereinafter referred to as "Gulf- ` Atlantic"; W I T N E S S E T H: WHEREAS, Gulf-Atlantic did on February 18, 1972 make, ~ execute and deliver a certain first mortgage deed to Bjarne ~ Ursin, which mortgage was recorded in O.R. Book 199, page 2268 of the public records of St. Lucie County, Florida, and which mortgage deed encumbered certain real property in St. Lucie County, Florida, owned by Gulf-Atlantic, as more fully described in said mortgage deed, as security for an original principal debt of $252,373.90, evidenced by a promissory note, which promissory note was set out in said mortgage deed; and WHEREAS, the Association became the owner and holder of record of said first mortgage above described and the promissory note secured by the same by assignment of mortgage from Bjarne Ursin dated September 22, 19~72, recorded in O.R. Book 247, page 6I of the public records of St. Lucie County, Florida; and WHEREAS, the Association partially released from the lien of its first mortgage above described the real property as more fully described. in that certain partial release of moXtgage dated October 6, 1972, recarded under Clerk's File No. 239404 in O.R. Book 207, page 62 of the public records of St. Lucie County, Florida; and WHEREAS, Gulf-Atlantic did on October 6, 197i make, _ execute and deliver a certain second mortgage deed to the Association, securing a principal debt of $96,267.38,which mortgage was recorded in O.R. Book 207, at page 65 of the public records of St. Lucie County, Florida, and encumbered the real property in St. Lucie County, Florida, more fuZly described therein, consisting of all of the real property formerly encumbered by the Association's first mortgage, less and except the parcel partially released as aforesaid; and VIHEREAS, Gulf-Atlantic and the Association did on- October 6, 1972 make and execute a certain mortgage consolida- ` tion and modif ication agreement, which agreement was recorded in O.R. Book 207, at page 67 of the public records of St. Lucie G County, Florida, and which agreement was intended to consolidate ~ E the indebtednesses and merge the liens of the first and second ; ~ mortgages held by the Association; and ~ ~ WI~REAS, the descriptions of the property set forth in said partial release of mortgage, second mortgage and mortgage ~ consolidation and modification agreement are in error, and f Gulf-Atlantic and the Association, as mortgagor and mortgagee ~ E respectively, have mutually agreed that said instruments should ~ be modified and amended so as to correct the errors in descriptions; NOW, THEREFORE, in consideration of the foregoing and other good and valuable considerations and the mutual covenants and promises herein made and the sum of One Dollar ($1.00) each ~ F THIS INSTRUMENT PREPARED BY: ; Frank H.
