HomeMy WebLinkAbout1228 called "Income") and principal as follows: (A) During the lifetime of the Settlor, unless Che trust is sooner revoked, the Trustees shall pay the Income quarter-annually~to or for the benefit of the Settlor. Tn the . event of the Settlor's mental or physical incapacity, as certified to the Trustees by her personal physician, the Trustees are authorized to expend the Income and also the principal of the Trust Estate to such extent and in such manner as the Trustees in their sole discretion sha21 deem to'be advisable for the-comfortable maintenance and support of the Settlor during such period of incapacity. (B) Upon the death of the Se[tlor, the Trustees shall divide the Trust Estate, including asse~s received from the Settlor's estate, into two separate trusts as provided in Articles Two and Three hereof. ARTICLE 1W0 ~ If the Settlor's husband, GEORGE H. DAGGETT, survives her, the Trustees shall hold as - TRUST A a portion of the Trust Estate, including any property added thereto by Settlor's Will, as a separate trust for his benefit (undiminished by any estate or inheritance taxes or other governmental charges) an amount equal to fifty (50%) per cent of the value of Settlor's adjusted gross estate as finally determined for Federal estate tax purposes, less the aggregate amount of marital deductions, if any, allowed for such tax purposes by reason of property or interests in property passing LAW OFFICp MGDOWELL,.
