However, in any event, all of such construction must be completed prior to June 1, 1975. 6. USE OF DEMISED PREMISES BY LESSEE, APARTMENT OWNERS, FAMILY MEMBERS AND GUESTS. The recreational facilities to be constructed upon the parcel of land described in Exhibit A may be used by the Lessee, by its members, by the owners and occupants of the con- dominium apartments that are located upon the land described in ~ Exhibit B and that are operated by the Lessee, and by the visitors ; and guests of such owners and occupants. Such use will be only ~ for recreational purposes and for the purpose of the assembly of ~ such persons; it may begin only after the construction of said recreational facilities has been substantially completed; and it will be in compliance with the rules and regulations established by the Lessee. i However,,a portion of said facilities may be used by the Lessee.or by any others responsible for the management of such condominiums, as a management office. Any portion so used must not exceed a reasonable area and such use must not interfere with the above described use of said facilities. 7. USE OF DEMISED PREMISES BY OTHERS. This Lease does not grant the exclusive right of - possession or use of the Demised Premises, or any part thereof. The Lessor reserves the right to enter into additional leases demising the parcel of land described in Exhibit A and demising ~ the recreational facilities to be constructed and installed thereon to others. However, such additional leases will not be made unless said recreational facilities are adequate to serve all who may become entitled to their use; and each of such additional leases will contain the following provisions: . , ; a. That the lessee must, at all times during . I the term thereof, own or have the right to possess, use and ' occupy an apartment or other residential unit located upon ~ any portion of the land described in Exhibit B. ! ~ b. That the use of the demised premises is restricted to recreational and assembly purposes; and is subject to rules and regulations of the Lessee herein. j c. That the Lessee or the Lessor will, at all ~ times during the term thereof, be obligated to pay a part of ~ all costs incident to the maintenance and operation of said ~ recreational facilities, including but not limited to the cost of repairs, replacement, servicing of equipment, utilities, taxes and insurance. The amount to be paid will be determined in the following manner: The number of square feet of living area within the walls (as taken from building plans) of said apartment or other residential unit will be divided by the total ~ square feet of living area within the walls (as taken from ~ building plans) of all such condominium apartments operated ~ by the Lessee and of all other apartments and residential units ~ located upon any portion of the land described in Exhibit B, provided a lessee as herein described owns or has the right ~ to possess, use and occupy such other apartments and residential units. The resulting percentage will be the percentage of all such costs to be paid by said lessee or by the Lessor. -5- FEE.
