DISCLAIMER
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, by? seven certain warranty deeds appearing in the public
records of St, Lucie County. Florida in Official Record Book 136 at pages
374, '3?6. 379. 381. 383, 385. and 387, respectively. numerous lots in the
several units of Lakewood Park Subdivision in St.~ Lucie County. Florida
~were conveyed to Donald L. 5hephard as Trustee and Jerome A. Simons
as Trustee without therein naming the beneficiaries of such trust and which
. recorded instruments did not specifically confer on the trustees ~the power
and authority either to protect, conserve and to sell, or to lease or to
encumber, or otherwise to manage and dispose of the real property described
in saad recorded instruments, all as provided by Section 689. 071 Florida
Statutes; and
WHEREAS, the said Donald L. Shephard and Jerome A. Simons,
thereafter acting in good faith and in pursuance of the terms of a certain
Declaration of Trust of record in O. R. Book 137, page 469, as trustees.
made, executed and delivered numerous deeds of conveyance with full
! cove~ants of warranty as to the several lots which are the subject of this

~ Disclaimer, which said lots are more_particularly described in schedule "A" t

~ hereunto appended and made a part hereof, and in each instance the grantee(s)
named in such deed paid the full consideration in cash or by mortgage note: and
WHEFEAS, the question has ~arisen as to the effectiveness of the last

mentioned deeds of conveyance with respect to the individual interest in such
lots so conveyed as might be held by~Donald L. Shepherd and Jerome A. Simons
and the dower rights of their respective wives:
NOW, THEREFORE, the premise stated, the said Donald L. Shephard

~ Barbara A. Simons do hereby remise release quit-claim and disclaim unto

each of the grantee(s) named and designated in the several warranty deeds
