Nothing ccntained in this Agreement shall be construed to prevent either party from instituting an action for divorce.in any competent jurisdiction against the other because of any past or future fault on the other's part, subject to the following: , a. In any divorce action, the Wife, provided the Husband is not in default urider this Agreement, shall make no claim for alimony, either temporary or permanent, for r suit money, either temporary or permanent, for attorneys fees, except in accoraance withthe provisions of this Agreement. b. This Agreement may be offered in evidence by either party in any divorce action and, if acceptable to the court, . shall be incorporated by reference in the judgment that may be rendered. However, notwithstanding, incorporation in the judgment, this Agreement shall not be mereged in it but shall survive the judgment and be binding on the parties for all time. ` ~ 5. REPRESENTATION. The parties represent to each other: a. The Wife has had opportuni-ty to have individual and ~ ' i independent legal advise by counsel and has voluntarily ~ - ~ agreed to execute this document and intends to be bound by E ~ it. ~ b. Each has made a full disclosure to tYie other of his or her current financial condition. c. Each understands and agrees that this Agreement constitutes the entire contract of the parties. It super- 4 sedes any prior understandings or agreements between them ; upon the subjects covered in this Agreement.
