This is a second mortgage and is subject and inferior to that certain mortgage made by Charles W. Maxwell and Wanda K. Maxwell, his wife, in favor of Security Federal Savings ; ~ Loan Association of Indian River County, dated September 17, 1970 and recorded in Official Records Book 187, page 369, Public Records of St. Lucie County, F9orida. Any ' default in said firs[ mortgage shall automatically constitute a default under this mortgage. _ . 4 If a conveyance should be made by the m~rtgagors of the premises he~ein described, or any part thereof, wit~out the written consent of the Association, and without assumption in regular form of law F~ the grantee of the obligations to the Association created by said promissory note and this morY- gage, then, and in that event, and at the option of the Association, and without notice, all sums of ~ money secured hereby shall immediately and concurrently w;th such conveyance become due and pay- t able and in default. The Association reserves the right to withhold consent to any such conveyance ` and assumption unti~ and unless satisfactory financial reports and other personal data required by the Associatian are furnished to the Association by the party acquiring title to the premises, or any part thcreof. By giving its consent to such conveyance, the Association shall not be deemed to have re(eased the mortgagor hereunder from any liability hereunder. The Association may deat with successors in in- terest with reference to this mortage and the debt hereby secured in the same manner as with the mortgagors, and may forbear to sue or may extend time for payment of the debt, secured hereby, or ott~erwise act without discharging or in any way affecting the l;ability of the mortgagors hereunder 3 or upon the debt hereby secured. The Association may also deal with the Mortgagors and/or with ' successors in interest ~vith~reference to this mortgage and the debt hereby secured by forbearing to ~ sue, extending the time for payment of the debt, providing_for different monthly payments and/or a different interest rate, and by other express modifications oi the contract, without losing any priority the Association has over other mortgagees or tienors or holders of any junior interest in the property secured hereby. Together with all buildings, improvements, fixtures or appurtenances now or hereaiter erected there- on or placed therein, including all apparatus, equipment, fixtures or articles, wf,ether in single units or cenLrally controlled, used to supply heat, gas, air conditioning, water, light, power, refrigeration, ventila- tion or other services, and any other thing now or hereafter therein or thereon, includ+ng screens, window i shades, stQrm doors and windaws, floor coverings, streen doors, awnings, stoves and water heaters ' (al! of which are +ntended to be and are here5y declared to be a part o~f;said real estate whether physic- ~ ally attached the~eto or not); and also together with all easements and the rents, issues and profits of said premises which are hereby pledged, assigned, transterred and set over unto the Mcrtgagee, whether now due or her~afier to become ciue as provided in the Supplemental Agreement ser_ured hereby.
