Mortgagor, and all right, title and interest of Mortgagor thereunder,
including, without limitation, cash or securities deposited there-
under to secure performance by the lesaees and vendees of their
obligatione thereunder, regardless of how aeid cash or ascurities
sre to be held by Mortgagor pursuant to the terms of such leases or
contracts. '
To Have And To Hold the above described property unto
Mortgagee, ita succeasors and assigns, forever~ sub~ect, however,
to the terme and conditions of thia Mortgage.
Provided, hawever~ that these presents are upon the con~
dition that if Mortgagor shall pay or cause to be paid to Mortgagee
' the principal and interest payable in respect to the Note secured
hereby, at the times and fn the manner stipuleted therein and herein,
all without any deduction or credit for taxes or other similar
charges paid by Mortgagor, and shall keep, perform and observe all
~nd singular the covenanta nnd praoisea in the Note secured hereby,
and any renewal, extension or modification thereof, and in this
Mortgage expreased to be kept, performed and observed by and on the
p~rt of Mortgagor, all without delay, then thi~ Mortgage, and all
the propertiea, intereat and rights hereby granted, bargained, sol~*
aliened, tesnieed, released, conveyed, aasigned, transferred, mort~
gaged, hypothecated, pledged, delivered, set ~ver, warranted and
confirmed, ahall cease, determine end be void~ but shal.~ otherw~se
remain in full force and effect,
Article I
Particula~c Covenants of Mortgagor
Mortgagor repreeents unto and covenants and agrees with
Mortgagee that: ~
; Section 1.01. Mortgagor warranta that it ia indefeasibly
` seized with the absolute and fee simple title in and to the Premises;
! that Mortgagor's title thereto is good and marketable; that it will
~ awn the peraonal property encimnbered hereby free end clear of liens
~ and claims; and Mortgagor has full pawer and lawful authority to
~ grant, bargain, sell, corney, tranafer and mortgsge the same; and
that it shall be lavful at any time h~reafter for Nortgagee to peace-
ably and qui~tly ~nt~r upon, have, hold and enjoy said property, and
~very part th~r~of; and that this Mortgage is and will re~oain a vel.id
and enforc~able first li~n on the mortgaged_property unleaa other~+ise
- hereinafter provided; and, unless othervise hereinafter provided, said
property is frae and discharged from all liena, encumbrances, and
claims of aay kind, ircluding taxes and aesesamenta; and that Mort-
~ gagor hereby fully aarrants the title to said property unto Mortgagee,
