PARCEL III: An easement for road right of way, public utilities and ingress and
egress over that portion of tl~e South 50 feet of the North 856 feet of Government -
Lots 1 and 2, Section 2, and Government Lot 1, Section 3, Township 37 South,
Range 41 East, lying between State Road AlA and a line which is 1800 feet Wea-
terly of and parallel to said State Road AlA.
RELEASES The lands lying Westerly of the landa which were released at the time
of closing, including all or any eubmerged lands, may be released upon payment of
the balance due on the mortgage.
Should the State of Florida require the reconveyance to it of the submerged
lands included in said mortgage in order to permit the full and unrestricted
use of the uplands as ahown on the aurvey of said lands by Stafford and Brock,
Engineers and Surveyors of Stuart, F`lorida, dated March 22, 1858, then and
in such event the mortgagee, their heirs or assigne will release such portions
and amounts of submerged land from the lien of this mortgage for the purpose
of reconveyance to the State of Florida without any payment by the mortgagor,
his heirs or assigns. Mortgagor, his heirs or assigns, shall execute a mortgage
modification agreement or such other documents ae may be necessary to encumber
any lands , permits , conveyances or other rights granted to him by the State of
Florida .
All payments made on the principal of this mortgage shall apply toward
partial re2eaaes whether requested at the time of said payment or not.
Mortgagor shall bear the expenses of preparation and filing all partial releases .
All payments of partial releases shall apply toward the next principal p&yments
becoming due under the mortgage .
Mortgagor-maker is not personally liable on the promissory note secured by this
mortgage and Mortgagee-payee is to look to the land as the sole source of payment .
Mortgagor shall have the right to remove and trar~sfer soil, rock or muck from
one area of the mortgaged property to other property which is the subject of this
Mortgage; - provided, however, that any or all of the foregoing muat be directly
connected with the development of the property and shall not be for any independent
commercial purpos.es. Mortgagor shall also have the right to place a sewage plant
and disposal system on the mortgaged property. ~
The holder of the purchase money mortgage agrees to join in the execution of a
~ plat or plats of sabdivision or declarations of condominium, provided that there .
; shall always be accese to property remaining unreleased from the lien and en-
~ cumbrance of the purchase money mortgage . _ ~
