Home My WebLink About1373 , ~ . 4: The maker hereof agrees to perform all of the obligations re- i quired by the Other Mortgages and other instruments securing the pay- ment of the O~her Notes. If at any time prepayment of the Other Notes, whether by acceleration or otherwise, is lawfully required by the holders • thereof, che holder of this note may, at its o.ption, advance hereunder the amount necessary to make such payments. . Upon payment of the face amount hereof less the then unpaid principal balance due on the Oi:her Notes, the holder hereof shall can- cel this note and release the mortgage deed securing the payment hereof, and the holder hereof shall then be reli.eved of any Eurther obligation ~ to make any further payments on the Other Notes. This note may be prepaid in whole or in part at any time without penalty. All agreements between the maker and the holder hereof are hereby expressly limited so that in no contingency or event whatsoever, whether by acceleration of the maturity hereof or otherwise, shall the amount paid or agreed to be paid to the holder hereof for the use, forbearance or detention of the money to be loaned hereunder exceed the maximum per- missible under applicable law. If, from any circumstance whatsoe~~er, ful- fillment of any provision hereof or of the mortgage deed securing this note, at the time performance of any provision shall be due, shall involve trans- { cending the li.mit of validit~? prescribed by law, then, ipso facto, the obliga-~ tion to be fulfilled shall be reduced to the limit of such validity, and if from any circumstance the holder hereof should ever receive as interest an amount which would exceed the highest lawful rate, such ~ amount which would be excessive interest.shall be applied to the reduc- ; tion of the principal hereof and not to the payment of interest.
