This cause coming on before the Court on the Defendant
LUCILLE V. COSTA'S motion to compel ar~swers to interrogatories -
and it appearing that said Defendant served Plaintiff with inter-

rogatories on or about April 24, 1973, and that the original of
said interrogatories served upon the Plaintiff together with !
its answers thereto have not been filed with the Court as of
the date of the hearing although copies of what purport to be
` answers were received by said Defendant on the date of the

~ hearing, to wit, July 2, 1973; and ~

~ IT FURTHER APPEARING by the testimony of Charles R. P. Brown,

~ Esquire, that a reasonable attorney fee for said Defendant's
~
~ attorney in bringing said motion to compel answers to inter-
~ rogatories for failure on the part of the Plaintiff to answer
~
~
` same would be the sum of $50; and
a
IT FURTHER APPEARING that counsel of record for the Plaintiff
3 were served with notice of this hearing, and the Court having

- heard argument of Defendant LUCILLE V. COSTA'S attorneys, and
~ being otherwise advised in the premises, it is.
