HomeMy WebLinkAbout0009 ~(c) Mortgagor shall furniah to Mortgagee, within thirty (30) days after a request by Mortgagee to do so, a written statement containing the names of all lessees of the Premises, the terms of their respective leases, the space occupied and the rentals payable thereunder. (d) The rights of the lessee under each lease of the premises, or any part thereof, shall be inferior and subordinate to this Mortgage, and the lien thereof, and upon the enforcement by Mortgagee of the remedies provided for by law or b~y this Mortgage, the lessee thereunder will, upon d~mand of any person succeeding to the interest of Mortgagor as a result of such enforcement, (i)~~ vacate and surrender the property demised under the lease, or (ii) become the lessee of said euccessor in intereat, without change in the terms or other provisions of such lease, provided, ho~ever, that said succeasor in interest shall not be bound by any prepay- ments of rent or additional rent for more than two (2) months in advance, or prepayments in the nature of security for the perform- ance by said lessee of its obligations under said lease, or any a~nendment or modification of the lease made without the consent in writing of I~fortgagee or euch successor in interest. Each lease shall also provide that, upon de~mand by said successor in interest, such lesaee ahall execute and deliver an instrtmment or instruanents confirming such attornment. Section 1.14. lhat Mortgagor hereby assigns to Mortgagee the rents, issues and profite of the mortgaged property ae further security for the payment of the indebtednesa secured hereby and Nortgagor grants to Mortgagee the right to enter the mortgaged prop- erty, or any part thereof, for the purpose of coZlecting the same snd to let the mortgaged property, or any part thereof, and t~~~ply said rents, issues and profits, after payment of all neceesary charges and e~cpenses, on account of 8aid indetedness; that this aseig~ent and grant shall continue in effect until the indebtedne~~ secured by this Mortgage ia paid, but Mortgagee hereby waives the right to enter the mortgaged property for the purpose of collecting said rents, iseue~s and profite, and Mortgagor shall be entitled to collect and receive said rents, issues and profits, until the occur- ~ rence of a default by Mortgagor under the terms and provisions hereof; f that Mortgagor agrees to uae said rents, issues and profita in payment of principal and/or interest payable pursuant to the Note secured i hereby, and in payment of all taxes, a8seasments, water r~ntt, sewer s renta and other chargea on or againat the mortgaged propertq; that auch right of Mortgagor to collect and receive said rent~, issues and profits may be revoked by Mortgagee upon any default by Mortgagor ; under the terms and provisions of thia l~rtgage; that, in respect ; of any lease i+hich no~ or at any time is entered inta, Mortgagor will ; (a) fulfill or perfoYm each and every teim, covenant and provision ~ of any such lease to be fulfilled or perfosmed by the lessor there- s under; (b) give praapt notice to Mortgagee of any notice received ; by Mortgagor of default bq the lesaor thereunder, together With e ~ ; . ; -9- ~ ~ - o ~ 215 `,:~f S25 3~K zis ~9 ; . ~ - . ; WILLIAMS.
