HomeMy WebLinkAbout0011 (b) if default shall be made in the due observance or perfoYmance of any covena~t or agreement on Che part of Mortgagor contained in Section 1.01, 1.03, 1.08, or 1.09, other than the non-payment of monies, and such default shall have continued for a period of twenty (20) days after written notice thereof shall have been given to Mortgagor by Mortgagee; or (c) if default shall be made in the due observance or performance of any other covenant or condition on the part of Mortgagor in this Mortgage contained, other than the non-payment of money, and such defau2t shall have con- tinued for a period of twenty (20) days after written notice specifying such default and demanding that the same be remedied shall have been.given to Mortgagor by Mortgagee; or (d) if by the order of a court of competent juris- diction, a trustee, receiver or liquidator of the mortgaged property or any part thereof, or of Mortgagor shall be appointed and such order shall not be discharged or dis- missed with in thirty (30) d8ys after such appointment; or (e) if Mortgagor shall file a petition in bank- ruptcy or for an arrangement or for reorga~ization pursuant to the Federal Bankruptcy Act or eny similar law, federal or state, or if, by decree of a court of competent juris- diction, Mortgagor shall be adjudicated a bankrupt, or be declared insolvent, or sha11 make an assignment for the benefit of creditors, or shall admit in writing its in- ability to pay its debts generally as they becane due, or ~hall consent to the appointment o£ a receiver or receivers of ell or any part of the mortgaged property; or (f) if any of the creitors of Mortgagor shall file a petition in bankruptcy against Mortgagor or for reorgani- zation of Mortgagor pursuant to the Federal Bankruptcy Act . - or any similar law, federal or state, and if such petition shall not be discharged or dismissed within thirty (30) days after the date of which such petition was filed; or E (g) if final judgment for the payment of money shall ~ be rendered against Mortgagor and Mortgagor shall not dis- charge the same or cause it to be discharged within thirty ~ (30) days fran the entry thereof, or sha11 not appeal i therefram or from the order, decree or proces$ upon which or purauant to ~hich said judgnent was granted, based or f entered, and secure a stay of execution pending such appeal; or ; i (h) if any of the events en~maerated in clause8 (d) through (g) of this Section 2.01 shall happen to the Guer- r antor, if any, or any of its property; or (i) if it shall be illegal for Mortgagor to pay ~ any tax referred to in Section 1.08 hereof or if the ; ~ ~ ~ -11- ~ ~~0!c 21C~ ~Gf ~ ~ a . ~j ~ :~IK~~V '~irf I 3 " WILLIAMS, 3ALOMON.
