Developer has not executed any prior assignment of said rights,
privileges and benefits, nor h as Developer performed any acts or
executed any other instrument which might prevent Lender from operating
under any of the teYms and provisions of this Assignment, or which would
limit or restrict Lender in such operation.
All the covenants and agreements herein contained on the part
of either party to be kept and performed shall apply to and bind their
respective heirs, personal representatives, successors and assigns.
IN WITNESS WHEREOF, Developer has executed this Assignment
in form proper and sufficient in law to bind Developer this 3-
day of June, 1973.
