STEBBINS, as to an unc.~ivided 50$ interest, and GORHAM CONSTRVCTION COMPANY EMPLOYEE PROFIT SHARING TRUST, as to an undivided 50$ interest, hereinafter called the Mortgagor, to SUN BANK OF FORT PIERCE, hereinafter called the Mortgagee: (Wherever used herein the terms "mortqagor" and "mortgagee" include all the parties to this in- strument and the heirs, legal representatives and assiqns of corporations; and the term "note" in- cludes all the notes herein described if more than one . ) . - WITNESSETH, that for good and valuable considerations, and also in consideration of the aggregate sum named in the promissory note of even date herewith, hereinafter described, the mortgagor hereby grants, bargains, sells, aliens, remises, conveys and con- firms unto ttie mortgagee all the certain land of which the mort- gagor is naw seized and in possession situate in St. Lucie County, Florida, to wit: - Begin at the NE corner of vacated Block 1$, MARAVILLA TERRACE, Plat Book 5, page 50, then run North 177 feet to the NE corner of Block 17, then run West 667.88 feet to the NW corner of Block 20, thence South on the East right of way of South 19th Street, 225.8 feet, thence East 125 feet, thence South 120 feet, thence East 206.8 feet, thence North 272.9 feet, thence Southeasterly to the NE corner of Block 18, to the point of beginning; and Begin 25 feet East of SE corner of Block 19, MARAVILLA TERRACE, as shown on plat recorded in Plat Book 5, page 50, then run North 272.9 feet, thence Southeasterly to the NE corner of Block 18, thence South along the East line-of Block 18, 145.9 feet, more or less, to the SE corner of Block 18, then West to point of beginning. _ TO HAVE AND TO HOLD the same, together with the tenements, hereditaments and appurtenances thereto belonging, and the rents, issues and profits thereof, unto the mortgagee, in fee simple. AND the mortgagor covenants with the mortgagee that the mort- gagor is indefeasibly s~ized of said land in fee simple; that the mortgagor has good right and lawful authority to convey said land ~ as aforesaid; that the mortgagor will make such further assurances to perfect the fee simple title to said land in the mortgagee as - may reasonabZy be required; that the mortgagor hereby fully war- rants the title to said land and will defend the same against ' the lawful claims of all persons whomsoever; and that said land is free and clear of all encumbrances.
