At the comnencement of the trial on June 27, 1973, Defendant's
attorney stated that the Defendant conceded that Plaintiff was ~
' entitled to the accounting requested in Count IV oP the Amended ~
Complaint, and the attorneys for both parties then stipulated,
! sub~ect to the Court's approval, that Count IV of the Amended

Complaint and the Counterclaim contained in the Answer to the Amende

f Complaint be severed from this cause and be disposed of at a
separate trial. Plaintiff's attorney then requested that the ~

i foregoing concession and arrange~ent for the disposition oP Count

; IV and the Counterclaim be ref2ected by a Pormal order. Accordingly ~

i by virtue of the foregoing and upon the sub~oined consents of the ~

attorneys for the parties herein, it is

ORDERED, efPective as of the commencement of the trial: '
