land and timber and whether assessed to the Vendors or the Vendee or ~
to both. This Agreement shall inure to and be binding upon the parties ~
hereto, their heirs, administrators, successors and assigns.
When the operation of either one or more of the manufactur-
ing mills of the Vendee or any assignee of this instrument are delayed ~
by labor strike~ of such mill w~orkers or failure of railroad carrier or
carriers to serve any such mills on account of labor strikes, the time ~
of such delay or interruption shall extend the term and duration of this '
agreement for the~length of the time of such delay or interruption. t

The time of such delay shall be calculated by the Iength of the strike f
of mill workers or by the number of days such railroads fail to serve
such mills, either or both. PROVIDED that Vendors shall be given writ-
ten notice of such strikes within ten (10) days of the commencement
of such strikes and further be given written notice of the termination
of such strikes by written natice. Failure by Vendee to serve such
notice shall void Vendee's right to extension during strike periods. ~

The Vendee agrees by his acceptance hereof that he will re- ~
pair any and all fences upon said property which are damaged by his
operations thereon~ That Vendee shall keep all gates closed and use '
due dili ence-to avoid cattle loss or e c ~

In order to f inance his operations, the Vendee may assign
all of his rights under this agreement as collateral security for i

such loan or loans as the Vendee may deer? advisable. vo such assign- ~
ment shall relieve the Vendee of any of his obliqations under this =

instrument. Any person to whom this instrument is so assigned, shall
after Vendee's default under the collateral assignment, have the •
right to exercise all of the rights and privileges of the Vendee under ~
~
this instrument. Any assignee which actually exercises its rights -
under such assignment shall do so in accordance with the terms of this
instrument, and this paragraph shall not relieve any assignee of lia-

bility for its own conduct in exercising any such rights. .
That Vendee acknowledges estimate in excess of $9,000.00 '

timber value, as herein described. That Vendors shall be entitled to ~
