default under all of said mortgaqes and the respective notes '
secured thereby. Upon the happening of any of said events the ;
whole indebtedness secured by each reapective moztqage shall, - ~
at the option of the Mortqagee, become due and payable withQ~~t t
notice or demand and each respective mortgage may be foreclosed ~
at once, anything contained therein to the contrary notwith- t
standing. 4

2. The aforesaid mortqages (1) and (2-) and the notes secured
thereby shall be modified by changing the words and figures "eight
~ percent (8$)", wherever.~they may appear, to read "nine and one-
half percent (9-1/28".
3. That all the property described in each of the aforesaid
mortgages shall remain in all respects subject to the lien, charge ~
or encumbrance of each respective mortgage, and nothing herein
contained or done pursuant hereto shall~•attect or be construed
to affect the lien, charqe or encwnbrance affected by each of
said mortqages, or the priority thereof over other liens, chaiges,
encumbrances or conveyances.
4. Notwithstanding anything herein to the contrary, this ~
Agreement shall not affect or impair any representation in re- ~
gard to and/or war,ranty of title heretofore made by the Mortgagor, ~
all of which shall remain in force and inure to the benefit of ~
the Mortgagee and any insurer of the title to said property or
the lien of the mortgages, thereon.
5. This Agreement shall be binding upon and shall inure
to the benefit of the heirs, personal representatives, successors
and assigns of the respective parties hereto.
