This cause came on for hearing on Plaintiff's Motion for _
Summary Judgment in favor of Plaintiff and against Defendant. Henry
Mack. Upon hearing argument of counse! and review of the pleadings ~
affidavit and proofs on file. this Court finds as foltows:
1. That this cause was brought in the proper venue and
this Co~rt has jurisdiction to render this judgment.

! 2. That there is no genuine issue as to any material fact

~ and that Plaintiff is entitled to a judgment as a matter of law.
3. That the Defendant 6erein. HENRY MACK. is indebted
to Plaintiff for the sale of inerc6andise to Defendant on an open account
~ in the amount of Five Thousand, Seveaty-seven Dollars and one cent,

months following April 25, 1~73. plus costs of suit in the amount of
Tvventy-seven Dollars and fifty cents ($27. 501. ~

Defendant,HENRY MACK, the amount of Five Thousand, Two hundred
