- The plaintiff, pursuant to Rule 1.420(a)(1) of the
Florida Rules of Civil Procedure (effective January 1, 1973),
files this notice of dismissal without prejudice and says:
1. The plaintiff secured a,temporary halt to the
construction activities of the defendants, and pursuant to an
agreement with representatives of defendant Lucille V. Costa,
a survey of the property was made that was not conclusive.

2. It appears that a more extensive survey will be
i ~
t needed but no agreement can be reached on that survey under the 4

~ theory of this action.
~ 3. Therefore, it appearing that a more appropriate
