it is lawfully seized of said 2and in fee simple; that it has good
right and lawful authority to sell and convey said land,•that it
hereby fully xarrants the title to said land and will defend the
same against the lawful claims of all persons whomsoever; and that
said Iand is free of all encumbrances, except taxes accruing subse-
quent to December 31, 1972.
This conveyance is subject to the tollowing restrictions,
~onditions, covenants and reservations which are specifically imposed
on -the--1and conveyed- above . -
1. The real property conveyed herein shall be used ex-
clusively for the construction of residential dwelling and ancillary
facilities, provided that should the grantee se11 or otherwise convey
the subje~t property, it sha21 then be used exclusively for marine
research, scientific and educational purposes and shall not be used
for a commercial shipyard, provided always that the grantee may use
the property for repair, renovation, alteration or maintenance of
vessels, vehicles or equipr~ent, used in or related to the operation
of~marine research, scientific and educational activities.
2. No building shall be constructed nearer than 50' to
the bulkhead line of the channel situate on the property herein
conveyed.
3. The height of any building constructed on the property
conveyed herein shall not exceed two stories.
4. Grantee shall not erect buildings or other appurtenances _
on more than 50~ of the available dry land situate on the premises ;
conveyed herein.
S. The grantee, his heirs and assigns, at his sole expense,
shall naintain that portion of the channel situate on the property
described above, to include but not be limited to the channel bed,
M•aterway and bulkheads, in a state of good maintenance and repair,
