AFI~'IDAVIT OF CARL F. ELLWANGER
REGARDING
FEDERAL ESTATE TAX IN CONNECTION WITH
ESTATE OF DAVID KANTOR, DECEASED
BEFORE ME, the undersigned authority, personally appeared
CARL F. ELLWANGER, who, after being first duly sworn, deposes and
says as follows: +

1. That I am an Attorney at Law, duly licensed in the State
of Florida. In that connection, I re~resented Beach Club Colony of Stuart, Inc. ,
a Florida corporation, when it purchased from Venture Out In America at St.
Lucie, Inc. , a Florida corporation, a~n December 15, 1970, a parcel of realty
situate in Government Lots 1, 2, 3 and~ 4, Section 11, Township 3? South, Hange
41 East, St. Lucie County, Florida.
2. That, prior to that date, I had obtained from Attorney
Nathan Tannenbaum, 521 Fifth Avenue, New York, New Yor]c, the Estate Tax
Closing Letter issued by United States Treasury Department, Internal Revenue
Setvice, in connection with the Estate of David Kantor, Deceased, who died
July 7, 1961. That Estate Tax Closing Letter is attached hereto and made a
part hereof. Attorney Nathan Tannenbaum was the attorney in said Estate.
' 3. That, despite repeated attempts subsequent to that date to
j - obtain a duplicate original copy of this Estate Tax Closing Letter, I have been
~ = unable to do so. However, I have been repeatedly assured, and my own inde-
~ ~ pendent investigation has confirmed the fact, that the attached Estate Tax
; r~ Closing Letter is a true and correct copy of the Estate Tax Closing Letter is-
~ ,-r, ~ sued by United States Treasury Department, Internal Revenue Service, in con-
~ nection with the Estate of David Kantor, Deceased. ~

~ ry 4. That~ I make this Affidavit for the purpose of clearing up any
& uncertainty as to whether such an Estate Tax C2o~ing Letter was ever issued in
_ connection ~vith the Estate of David Kantor, Deceased, and further to provide in
a recordable form, such evidence.
