to any action therefor.
In the event of an action by either party to enforce the _
terms of this Agreement, the prevailing party shall be entitled to
recover from the defaulting party all expenses involved, including
court costs and reasonable attorneys fees. The party of the first
part hereby assigns and conveys to the parties of the second part
all warranties and guarantees resulting from the constructnn of
the improvements on the above described property and the placement
of appliances and fixtures therein.
It is mutually agreed by and between the parties hereto
that the time of payment shall be an essential part of this
Contract, and shall be promptly paid within thirty (30) days next
after any installment becomes due, and that all covenants and
agreements contained shall extend to and be obligatory upon the
successors, heirs, executors, administrators and assigns of the
