ORDER GRANTING SEPARATE TRIAL
THIS CAUSE having come on before me on the Defendant's
Motion for a separate trial on the sole issue of ownership of
the vehicle involved in the accident, and the Court having heard , :
argument and having been advised in the premises, it is,
ORDERED AND ADJUDGED that this issue shall be severed and
~ tried separatly and shall preceed the trial of the case on the
merits, should such trial be necessary, it is further, }
ORDERED AND ADJUDGED that at this trial the sole issue be-

; fore the jury is whether or not the truck alleged in the Complaint _
~
~ to have been owned by Earl V. Turner was in fact owned by Turner
i
~ Machine & Supply Company, Inc. thereby precluding suit because ;
~ of the exclusive remedy provisions of the Workmen's Compensation
~
~ Act, all parties being agreed that the Plaintiff's accident occured
~ in the course and scope of his employment by Turner Machine & Supply ;
~
~ Company, Inc. ~
