FRUIT PURGHASE CONTRACT ;

TAIS CONTRACT, made this day of September, 1973, by f

and between FLORID~A MAID CITRUS CORP., "Seller" of Fort Pierce,
Florida, and BOWEN BROTHERS, INC „"Buyer", of Winter Haven, Florida.-- {
WITNESSETH, that the Seller does hereby bargain, sell and
transfer unto the Buyer all the 1973-74 fruit of marketable quality
(cannery grade or better) at the time of picking fruit from the
following groves:
ALL THE PRODUCTION EXCLUDING
VALENCIA ORANGES ORIGINALLY
GROVE SIGNED UP WITH F.O.M.
Blocks 15, 16, 1~, 18, 19 Approx. 25,000 Tenples •
and 20 of the Florida Maid " 100,000 Grapefruit
Drainage District, St. Lucie " 25,000 Valencias ~
County, FZorida, containing " 18,000 Hamlins
approximately 954 acres. " 3,000 K Early Tangelos
" 10,000 Orlando Tangelos
1. The purchase price of all fruit shall be determined on
a mutual consent of both parties prior to picking; or, fruit will

be handled for account of grower and 10~ per box charged for ser- ~

vices rendered by Buyer, over and above the pick, load and haul, :

the processing or packing charged incurred in handling fruit. -

2. The picking and hauling shall be accomplished by Buyer, t

and fruit shall be picked and deZivered as directed by Buyer. "
3. Buyer has paid to Seller an advance of Two Hundred Fifty
Thousand ($250,000.00) DolZars, receipt of which is hereby acknowl- ;
edged, and said advance shall be recovered as fruit is picked. If
the entire advance is not recovered in that manner, then this
Contract shall remain in effect until the advance is liquidated.
4. The fruit covered by this Contract shall be picked at

such time as Buyer may direct. ;
5. It is mutually agreed that the Buyer, his agents and
employees shall have the-right of access to said grove or groves .
at all times for the purpose of inspection or removal of said crop ~
of fruit.
