This cause coming on to be heard before me this day, and
it appearing from the sworn Petition and the Court file herein
th~t service of process was duly and regularly had upon the

the nefendant notwithstandinq said summons, has fialed to
appe~r, answer or otherwise plead on the return day fixed
therein, and the Court being fully advised in the premises,
