HomeMy WebLinkAbout2939 Miller 20169 ~ 26~6~0 , ~ MORTGAGE MODIFICATION AGREEMENT WHEREAS, WALTER S. MILLER and MARY S. MILLER, his wife, did on July 11, 1973 make, execute and deliver a certain mortgage deed to FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE, a corporation organized and existing under the laws of the United - States of America, which mortgage was recorded in O. R. Book 216 at page 901 of the public records of St. Lucie County, Florida, and which mortgage deed encumbered certain real property in St. Lucie County, Florida, described as follows: A part of Lots 2, 3 and 4, Block 12, SILVER LAKE PARK ADDITION, as recorded in Plat Book 10, page 8, St. Lucie County, Florida, being more particularly described as follows: Beginning at the Southwest corner of said Lot 2, run North along the West line said Lot 2, 58.33 feet; thence run Northeasterly to a point on the East line of said Lot 4, said point being 95.5 feet North of the Southeast~,corner of said Lot 4; thence run South 95.5 feet to the Southeast corner of said Lot 4; thence run West 187.5 feet to the Point of Beginning. as security for an original principal debt of $23,300.00 evidenced by a promissory note, which promissory note was-set out in said mortgage deed; and WHEREAS, the description of the~property set forth in said mortgage is in error and the mortgagor and mortgagee have mutual~y agrEed that said mortgage shall be modified and amended so as to correct the error in description; NOW, THEREFORE, in consideration of the foregoing and other good and valuable considerations and the mutual covenants and r promises herein made and the sum of One Dollar ($1.00) each to the other paid, S~Talter S. Miller and Mary S. Miller, his wife, hereinafter called the Mortgagor, and FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE, hereinafter called the Mortgagee, agree as follows: r ~ ~ 1. That the mortgage deed dated July 11, 1973 and recorded ~ in O. R. Book 216 at page 901 of the public records of St. Lucie County, Florida, shall be modified, amended and corrected so that the description of the property encumbered by said mortgage shall be as follows: The South 81 feet of Lots 2, 3 and 4, Block 12 of SILVER LAKE PARK ADDITION, as recorded in Plat Book . 10, page 8, St. Lucie County, Florida. 2. That the above description as set forth in Paragraph 1 above is hereby and herewith made a part of said mortgage as though it had been originally described and incorporated therein. ~ . ~ 3.
