SALEEBY, ~7R. . ~ Plaintiff, . - -vs - . FRANK J. HAAS, , Defendant. . / FINAL JUDGEMENT THIS CAUSE came on for Non-Jury Trial on November 1, 1973, upon the complaint of the Plaintiff, GEORGE A. SALEEBY, JR., and the answer of the Defendant, FRANK J. HAAS. The Plaintiff, a duly licensed real estate broker, alleges an agreement between himself. and the Defendant, whereby he agreed to procure from the executors of the estate of Adrain M. Sample, deceased, a contract to sell to the Defendant certain real estate owned by the estate. The Plaintiff further alleges that the Defendant agreed, upon delivery by said owners to Defendant of a good and sufficient deed of con- veyance of said real estate, ta pay to Plaintiff as commission for his services the sum of $22,7t3, or three percent of the total purchase price of $~57,111.00; said commission to be paid in install- ments as the 1971-1972 citrus crop was harvested and sold. After alleging compliance with his part of the contract, the Plaintiff acknowledged payments from the Defendant totaling $18,000. In this suit, Plaintiff is claiming damages for the alleged unpaid balance of $4, 713. 00. ~ The Defendant in his answer alleges that the agreed commission ' was two and one-half percent or $18,000, that said sum has been paid, i and denies any further indebtedness to the Plaintiff.
