HomeMy WebLinkAbout1760 prejudice the rights of the owner of any PRIVATE DWELLING in the use and enjoyment of his PRIVATE DWELLING, unless sueh owner's written conaent has been obtained provided the making of such • alterations and improvements are approved by the eoard of Directors of said ASSOCIATION, and the cost of such alterationa or improvements sha 11 be assesaed as connnon expense to be assessed and coilected from all of the owners of PRIVATE DWELL2NGS. However, where any alterations and improvements are exclusively or substantfa lly exclusive~ly for the benefit of the owner or owners of a PRIVATE - DWELLING or PRIVATS DWELLINGS requesting the same, then the cost ~f such alterations or improvements shall be assessed against and collected solely from the owner or owners of the PRIVATE D~WELLING~or PRIVATE DWELLINGS exclusively or substantially exclusively benefited, the assessment to be levied in such proportion as may be determinad by the 8oard of Directors of ASSOCIATION. XX. . MAINTE~IdCE AND REPAI,R,~ BY OWNERS OF PRIVATE DWELLINGS Every owner must perform promptly a 11 maintenance and repair work within his PRIVATB DWELLING which, if omitted, would affect the CONDOMINIUM in its entirety or in a part belonging to other owners, said owner being expressly responsible for the damages and liabiZity which his failure to do so may engender. The owner of each PR2VATE Di~TELLING sha12 be liable and responsible for the maintenance, repair and replacement, as the•case may be, of all air conditioning and ~ heating equipment, stoves, refrigerators, fans, or other appliances or equipment, including any fixtures and/or their connections re- quired ~o provide water, light, power, telephone, sewage and sanitary service to his PRIVATE DWELLING and which may now or hereafter be situated in his PRIVATE DWSLLING. Such owner shall further be ; responsible and liable for maintenance, repair and replacement ~f any and alI wa lI, ceiling and floor, painting, decorating and furnishings, and all other accessories which such owner may desire to place or maintain in his PRIVATE DWELLING, except that no paintinq, decorating, modification or renovation shall be made to, on or upon the balconies appurtenant to the dwelling units. Whenever the maintenance, repair and replacement ~f.any items for which the owner of a PRIVRTE DWELLING is obligated to maintain, replace or repair at his own expense is occasioned by any loss or damage which may be covered by any incurance maintained in force by ASSOCIATION, the proceeds of the insur~nce received by ASSOCIATIOy, or the Insurance Trustee hereinafte~r designated, shall be used for the purpose of making such maintenance, repair or replacement, except that the owner of such PRIVATE DWELLING shall be, in said instance. ~ required to pay such portion of the costs of such maintenance, repair ; and replacement as shall, by reason of the applicability of any deductibility provision of such insurance, exceed the amount af the ~ ~insur~nce proceeds applicable to such maintenance, rep2acement. € The floor of the balcony attached to each PRIVATE DWELLING, if any, t shall be maintained by the owner of such PRZVATE DWELLING at his own expense, however, the cost of any repairs or other unusual - expense required for the maintenance of such balconies when occasioned by the act of the owner or his invitees shall be ~ directly charged to the owner and not be.considered a COMMON EXPENSE. ' A lthough window, sliding glass doors, plate glass installation and ~ screening are part of the COMMON PROPERTY, ordinary maintenance thereon ` and thereof, shall be performed by each PRIVATE DWELLING owner at his own coat and expense.
