DICKERSON, INC, and NAT HARRISON Savannas to an island located in the Savannas; that work has commenced to extend the c~useway east from said island to the east shore line of the Savannas; that the portion of the causeway east of said island has not been completed and does not entirely block the area between said island and the east shore line of the Savannas; that in the immediate area of the existing causeway, from the west shore line to said island, there has been permanent and irreparable damage; that if the causeway were continued from said island to the east s~ore line of the Savannas, there would be additional permanent irreparable damage within the im- mediate area of the causeway; that in addition to the permanent and irreparable damage done in the immediate area of the causeway, tempo- y z rary damage has resulted, and in the future would result if the work continued, due to the incrPased turbidity of the water on both sides of the work s ite . i . IT IS THEREUPON ORDERED AND ADJUDGED AS FOLLC)WS: - f 1. Defendants' oral motion to dismiss the complaint ~ , ~ ; and dissolve the Temporary Injunction, upon the grounds i ~ 3 ~ ; ~ that the court lacks jurisdiction of this cause and ~ , ' that the State has no authority over the waters of the ` ~ i ~ Savannas under Florida Statutes Chapter 403, be and ~ the same is hereby denied. 2. The Temporary Injunction heretofore entered by this court st?all remain in effect and apply to that portion of the Defendants' proposed construction east ~ ~ of said island to the east shore line of the Savannas ~ ~ and the Defendants, their agents, employees and servants . + ~ are enjoined and restrained from doing any further work ~ and/or dredging in this area, until further order of ~ ~ ~ court. ~ 3.
