Together with all appurtenances to the -said apartment including, but not limited to the undivided share of the common elements and rights of use to all easements. The mortgagors hereby assume ~nd agree to observe and perform all of their obligations and the obligations of the association under the said Declaration including, but not limited to the payme~t of assessments for the maintenance of the apartment and the Condominium. Any default thereof shall constitute a default in this mortgage and i the promissory note which the same secures. OF HfYENVE f_-' •;.t ' PURS~IM~T T~ ~ER roljitllS ~ P.. _~~-~73 j~ 3 3. 0 0 t ~p( ~IRCUIt OO11RT, sr. wc~E oo, ~ ~ ~ ~ ~ If a conveyance shoul~l be made by the mortgagors of the premises herein described, or any part ~ thereof, wit!~out th~ v~rittPn consent of the Association, and withou~ assumption in regular form of ~ law hy the grantee of the obligations to the Associatio~ created by said promissory note and this mort- gage, then, and in that event, and at the option of the Association, and without notice, all sums of ~ money secured hereby shall immediately and concurrently with such conveyance become due and pay- able and in defauit. The Association reserves the right to withhold consent to any such conveyance ~ ar~d assumpti~n until and unless satisfactory financial reports and other personal data requir~d by the ~ Assoc~ation are furnished to the Association by the party acquiring title to the premises, or any part ~ thereof. By giving its consent to such conveyance, the Association shall not be deemed to have released ~ the mortgagor hereunder from any liability hereunder. The Association may deal with successors in in- ~ terest with.refere~ce.to this mortage and the debt hereby secured in the same manner as with the ~ mortgagors, and may forbear to sue or may extend time for payment of the debt, secured hereby, or otF,erwise act without discharging or in any way affecting the liability of the mortgagors hereunder ` or upon the debt hereby secured. The Associatiori may also deal with the Mortgago~s and/or with ~ successors in interest with reference to this mortgage and the debt hereby secured by forbearing to ; sue, extendin~ the time for payment of the debt, providing for different monthly payments and/or a - different interest rate, and by other express modifications of the contract, without losing any priority ~ the Association has over other mortgagees or lienors or holders of any junior interest in the property secured hereby. ~ Together with all buildings, improvements, fixtures or appurtenances now or hereaiter erecied there- on or placed there~n, including all apparatus, equipment, fixtures or articles, whether in single units or - ~Y centrally controlled, used to supply heat, gas, air conditioning, water, light, power, refrigeration, ventila- tion or other services, and any other thing now or hereafter therein or thereon, including screens, window- ~ shades, storm doors and windows, floor coverings, screen doors, awnings; stoves and water heaters _ (all of which are intended fo be and are here5y declared to be a part of said real estate whether physic- ~;rt ally attached thereto or not); and alsa together with all easements and the rents, issues and profits af ~ said premises which are hereby pledged, assigned, transferred and set over unto the Mcrtgagee, whether now due or hereaf;er to become ciue as provided in the Supplemental Agreement ser_ured hereby.
