Ball, his wife, did on June 22, 1973 make, execute and deliver a certain mortgage deed to FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE, a corporation organized and existing under the laws of the United States of America, which mortgage was recorded in O. R. Book 215 at page 2276 of the public records of St. Lucie County, Florida, and which mortgage deed encumbered certain real property in St. Lucie County, Florida, described as follows: . Beginning at the SW corner of the NW 1/4 of Section 17, xowns~?in 35 South, Range 40 East, St. Lucie County, Florida, run North 88 degrees 30'21" East, a distance of 420.01 feet; thence run North 00 degrees 10'O1" East, a distance of 48.02 feet to the point of beginning; From said point of beginning run North 88 degrees 30'21" East a distance of 90 feet; thence run North 00 degrees 07'33" East a distance of 281.98 feet; thence run South 88 degrees 31'06" West, a distance of 90 feet; thence run South 00 degrees 07'33" West 281.98 feet, more or less, to Point ~ of Beginning. as security for an original principal debt of $31,800.00 evidenced by a promissory note, which promissory note was set out in said mortgage deed; and :~THEREAS, the description of the property set forth in said mortgage is in error and the mortgagor and mortgagee have mutually agreed that said mortgage shall be modified and amended so as to correct the error in description; NOW, THEREFORE, in cansideration of the foregoing and other good and valuable considerations and the mutual covenants and promises herein made and the sum of One Dollar ($1.00) each to the other paid, Charles E. Ball and Gloria D. Ball, his wife, hereinafter called the Mortgagor, and FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE, hereinafter called the Mortgagee, ; agree as follows: i ; 1. That the mortgage deed dated June 22, 1973 and recorded ; in O. R. Book 215 at page 2276 of the public records of St. Lucie ' County, Florida, shall be modified, amended and corrected so that € the description of the property encumbered by said mortgage shall ~ be as follows: ~ Beginning at the SW corner of the NW 1/4 of Section 17, Township ~ 35 South, Range 40 East, St. Lucie County, Florida, run North 88 degrees 30'21" East, a distance of 428.55 feet, more or ~ less; thence run North 00 degrees 10'O1" East, a distance ~ of 48.02 feet to the point of Beginning; From said point of ~ beginning run North 88 degrees 30'21" East a distance of 90 feet; thence run North 00 degrees 07'33" East a distance of ~ 281.98 feet; thence run South 88 degrees 31'06" West, a ~ distance of 90 feet; thence run South 00 degrees 07'33" West ~ 281.98 feet, more or less, to Point of Beginning. ; ~ ~ 2. That the above description as set forth in Paragraph 1 ~ above is hereby and herewith made a part of said mortgage as though i - it had been originally described and incorporated therein. : 3.
