SCOTT and her hus- ~ ban~i, LESLIE W. SCOTT, hereinafter called the Scotts; EDGAR R. BROWN and JOSEPHINE BROWN, hereinafter called the Browns; and LAKE HAMILI~ON CITRUS, INC., hereinafter called the Company. ; W I T N E S S E T H: WHEREAS, the State of Florida Department of Transportation is! { currently in the process of preparing plans on which to construct ~ a limited access highway through a portion of St. Lucie_County, i and ~ i ~aFRFec, p n~rtiQn ~f t~~ ~rQw~ propert_y in St. Lucie Countv,i _ . consisting of approximately 7 acres will be severed and landlocked~ by construction of the fence on said limited access highway and ~ would no longer have access to this road, and WHEREAS, the Company has had access and use of canal lying j ' between the Brown property and the Scott property from which to ~ , ; draw water for irrigation of its citrus groves, and ' i ~ ~ ~ WHEREAS, the continued access and use of this canal is perti-; ~ ; 6 - , ~ nent fio the successful operation of said citrus groves; ~ ~ ~ ~ ~ NOW, THEREFORE, it is cautually agreed that for and in consid-: ~ ~ ~ ~ ~ eration of the mutual benefits to the parties hereto, the Scotts, ~ - ~ ~ ~ ~ the Browns and the Company, the Scotts hereby grant unto the Brown~ ~ ~ and the Company a perpetual right-of-way and right of entry across' ~ ' ~ their property for the purpose of maintenance of the canal and ~ ~ ~ ~ - irrigation systems involved in the agreements heretofore entered ! ; into by the Scotts and the Browns, as recorded in O.R.
