This cause came on to be heard November 15, 1973 upon the
Defendant's Motion to Vacate Default, Defendant's Motion To Dismiss
for Failure to State a Cause of Action and Plaintiff's Amendment to
Motion to Set Case for N~n-Jury Trial, and both parties being
represented by counsel and the Court being fully advised in the
premises, it i.s ordered and adjudged as follows:
1. The Defendant's Motion to Vacate Default be and the same is
hereby denied. `
2. The Defendant's Motion to Dismiss for Failure to State a
Cause of Action be and the same is hereby denied.
3. The Court holds in abeyance Plaintiff's Amendment to Motion
to Set Case for Non-Jury Trial. •
4. The Court grants to the defendant fourteen days from
November 15, 1973 to file its Answer herein setting forth the
issues.
