ORDER TRANSFERRING ACTION
THIS CAUSE came on to be heard November 15, 1973,
upon the defenses of improper venue set forth in the Answer of the
Husband, HAMILTON H. FLOYD, and the Motion To Dismiss by the ~
Defendant, H. H. FLOYD, INC., and it appearing to the Court that
the Husband and Wife both reside in Indian River County; the
cause of action for dissolution of marriage arose in Indian River
_
County and the property in 2itigation is located in Indian River
County and Palm Beach County, upon consideration thereof, it is
ORDERED as follows:
l. Said defenses of improper venue are hereby sustained, 4
2. This action is hereby transferred to the Circuit
Court of Indian River County, Florida.
3. The Clerk of this Court is hereby directed to trans-
mit to the Clerk of the Circuit Court of Indian River County, -
~ Florida, all original papers filed herein, except this original
Order Transferring Action, together with a certified copy of this
Order and a certified copy of all entries of record in the progres~
docket of this cause.
4. The defenses of lack of jurisdiction over the subject
matter and failure to state a cause of action raised in the Motion ;

To Dismiss by the Defendant, H. H. FLO:.'D, INC., will be considered ~
by the Court upon notice and further hearing held after this
action is transferred to Indian River County, Florida.
