This addendum to that agreement which was entered into by
and between CHARLES B. FULTON and IMOGENE C. FULTON~ his wife,
- hereinafter referred to as "Fulton", and PERRY BOSWELL, JR., and
PAMELA R_ BOSWELL, his wife,
~o~~, hereinafter referred to as "Boswell",
WITNES SETH•
WHERF~S, a misunderstanding has developed between the
parties with respect to the terms and conditions of the original
agreement and
WHEREAS, the parties desire to recognize and resolve all of
their said differences in this addendum.
NOW, THEREFORE, for and in consideration of the promises
and covenants set forth in the original agreement and the acts ,
to be performed hereunder, the parties hereto do hereby mutually
~ execute and deliver to each other this addendiun.
; 1. Boswell shall re-grade the road upon the 60 foot right-of-
~ way for a distance of 400 feet easterly from the County road so

{ that said road will slope from north to south, thereby in effect
~

~ providing a dike for the Fulton property for that distance.

~ of the County road (to the location of an existing equalizer which

~ is approximately 400 feet east of the County road) and Boswell shall
~ fill to grade and eliminate the existing ditch which extends from the

~ County road to a point 400 feet easterly thereof along the north
side of the 60 foot right-of-way.
~:7 3. Boswell shall eliminate the equalizer which is now located
~ 200 feet east of the County road.
