Boswell shall cut off the northerly extension of the equalizer on the north side of the 60 foot right-of-way so that it will not project uru~ecessarily into the drainage ditch. S. Boswell shall join the equalizers now existing at the ~ easterly terminus of the 60 foot right-of-way and construct thereover a vehicular cross-over to and from the ~lton property at that location; and by use of a bulldozer clear a roadway northerly of said 3unction and a~ right angles therefrom, which roadway shall be two bulldozer blades in width and shall extend northerly to the existing dirt road on the Fulton property, a distance of several hundred feet, more or less. This vehicular cross-over is to be constructed promptly, as the road and drainage ditch work progresses. 6. The drainage ditch along the full length of the 60 foot right-of-way shall be of sufficient depth and of adequate design to accommodate waters which normally collect in that area, so as to prevent the drainage thereof upon Fulton's property because of back- water or overflow. 7. Boswell shall plant grass along the banks of the drainage ditch and shall sod the area over, around and supporting the equalizers and the vehicular cross-over in a manner to prevent erosion and for the purpose of making the drainage ditch as attractive as possible. 8. If Boswell places a gate or any other obstruction across the 60 foot right-of-way during construction Fulton sha11 be provided with a key thereto. Except during the period of construction the right-of-way shall be unobstructed. 9. After the access road and drainage ditch have been completed, Boswell shall provide Fulton with a re-survey of the area, or with a certificate from a registered land surveyor or registered engineer, - 2 - d00K ~ PALE t!~
