which shall confirm and certify to Fulton the location of Che access
road and the drainage ditch as being entirely within the 60 foot
right-of-way and in conformity with the agreement between the parties
and this addendum, and which shall confirm and re-certify that the
existinQ monuments are accurate and correct with reference to the
original Stafford & Brock survey.
10. In addition to paying for the foregoing items, Boswell
shall pay to Gee and Jenson Engineering firm a fee in the amount of
$500.00 for engineering services performed by that firm for Fulton
in this connection.
11. Upon mutual execution and delivery by the parties of this
addendum Boswell may proceed with the construction of the road and
drainage ditch as provided far herein and in conformity with the
surveys and drawings which have been provided by Boswell to Gee and
Jenson.
~ 12. Nereafter Fulton may at his own expense construct such
~ further vehicular cross-overs to and from the said 60 foot right-of-

1 way as may be desirable for the development by Fulton of his property.

~ 13. Upon the completion of the access road upo~ the 60 foot

~ right-of-way and of the drainage ditch in connection therewith,

Fulton shall execute and deliver to Boswell a special warranty deed

~ to the 60 foot right-of-way, as provided for in the original agreement.

~ The original agreement and this addendum shall be referred to in said
~
~ deed, and shall be atzached thereto and incorporated therein by

~ reference, all of which shall be promptly recorded in the Public
~ Records of St. Lucie County by and at the expense of Boswell, with
the recorded documents, or a certified copy thereof, to be returned
~
to Fulton.

14. The original agreement between the parties, dated August 24,

1972, shall remain in full force and effect, except to the extent and
~ manner herein provided.

15. The original agreement and this addendum shall enure to
Y; the benefit of the heirs, personal representatives and assigns of the
