Agreement recorded in Official Record Book 209, at Pages 588 through
592, public records of St. Lucie County, Florida. • -
This conveyance is further subject to easements, restrictions,
reservations and rights-of-way of record and taxes accruing subse-
quent to December 31, 1972. -
TOGETHER with all tenements, hereditaments, and appurtenances
thereto belonging or in anywise appertaining.
TO HAVE AND TO HOLD the~same in fee simple forever.
AND the grantor hexeby covenants with said grantee that
it is lawfully seized of said land in fee simple; that it has good ~

right and lawful authority to sell and~ convey said land, that it :

hereby fully warrants the title to said land and will defend the
same against the lawful claims of a11 persons whomsoever; and that
said land is free of all encumbrances, except taxes accruing subse-

quent to December 31, 1972.
This conveyance is subject to the follawing restrictions,
conditions, covenants and reservations which are specifically imposed
on the land conveyed above. ~
1. The real property conveyed herein shall be used ex~lusively
for marine research, scientific, educational, training, schooling,
or associated, auxiliary and ancillary purposes to include but not
be limited to the construction and maintenance of underground
fuel facilities. Grantee shall not use the property for a commercial
shipyard provided always that grantee may use the property for
repair, renovation, alteration, or maintenance of vessels,
vehicles, or equipment used in or related to the operation of its
marine research, scientific, educational, training, or schooling
activities.
2. No building shall be constructed nearer than 30' to the
bulkhead line of the channel situate on the property herein con-
veyed, with the exception of the welding building and slab
presently within 12' of said bulkhead line.
3. The height of any building constrticted on the property
conveyed herein shall not exceed two stories, with the exception
