THIS CAUSE coming on to be heard before the Court on the
Motion of NORTH BEACH DEVELOPMENT COMPANY, Defendant, to dismiss Counts
I and II of Plaintiffs' Second Amended Complaint, and the Court hear-
ing argument of counsel for the respective parties, and the Court being
of the opinion that the cause of action under Counts I and ZI of the
Plaintiffs' Second Amended Comp~aint are insufficient for lack of ~
