l. APPROVAL OF PLANS AND SPECIFICATIONS: Grantee agrees that
no site p anning, inc u ing ve icu ar parking lot layout,
landscaping and outside lighting, buildings, a~ditions, or
alterations shall be undertaken on said site until the plans
and specifications for same have been approved by Grantor,
which approval shall not be unreasonably withheld. If
approval or disapproval of the plans and specifications is
not forwarded to the applicant within thirty (30) days
after date of request for approval, then such approval will
not be required.
2, RECONVEYANCE: Grantee by the acceptance of this Warranty
Dee hereby agrees that in the event said Grantee has not
caused to be constructed upon the property herein conveyed
a bank facility not later than June 30, 1974, then and in
such event the Grantor shall have the exclusive option to ~
repurchase the property hereby conveyed for the same price
paid by the Grantee herein to the Grantor herein for the
purchase of the subject property. In the event that it "
becomes necessary for the Grantor to exercise such option,
all expenses incident to the reconveyance, including but not
limited to documentary stamps and surtax required to be
affixed to the Warranty Deed and evidencing of title by way
of a title policy reflecting no greater encumbrances than
existed at the time of this Warranty Deed, shall be borne
by the Grantee herein. If the Grantee herein fails or
refuses to reconvey in accordance with the provisions of this
paragraph, the Grantor herein may also elect to bring an
~ action for specific performance, and in such event the Grantee ~
; herein shall be responsible for all court costs, expenses
~ ` and reasonable attorney's fees incident thereto.
