of Grantor measured from the North line of the property set forth in exhibit
"A" and running parallel thereto from the State Highway AlA Right of Way to
the Waters of the Indian River, provided that any drainage structures which may `
be installed in lieu of natural drainage shall be subject to the approval of
appropriate governmental authorities .
It is understood that the easement is given upon the express understanding
and condition that it may be used by Grantor, its successors or assigns in ~
conjunction with the use of Grantee, his successors and assigns .
It is further understood that Grantor, its successors and assigns in no way
will be bound to improve, maintain or repair the easement; nor does Grantor,
its successors and assigns assume any liability or responsibility to Grantee,
his successors or . assigns for the effects of the use of this easement, and in the
event that said easement is not used for the purpose intended after the Grantee,
his successors or assigns have developed the property set forth in exhibit "B",
then said easement sYall ter~hinate. ~
