The Grantor. his heira or aseigns reserves the right to place pipea or wires within ten (10) feet of the boundaries of any lot, and ahall alwaye have the right for himself, his heirs or assigns as and when may be most convenient to him to enter on said lot for the ~ purpose of erecting, ~xing, building. examiriing, maintaining or repairing ~such pipes, € conduits, electric lighta. telephone posts and wires, drainage pipes or swales, and other public aervices as in his apinion may be desirable or neceasary to place on the ten (10) ` foot atrip herein referred to; provided, however, that nothing herein shall be constructed to permit the division of any one owner's contiguoue parcel of land by auch ten (10) foot ; strip, when such contiguous parcel consiats of parts of more than one recorded lot. 13. All electrical and telephone service lines to individual lota shall be underground except where those main electrical and telephone tranemiasion linea are located on overhead poles running on the right of way from Gilson Road to the development proper , 14. The raising, maintaining or breeding of any domesticated animals or birds shall not be permitted on the premises; except that not more than two (2) in number of any species of household pets may be kept by the owner on the premisea . Littera Qf dogs and/ or cats shall be removed from Lhe premises not more than one hundred twenty (120) days from their birth . 15. No docks on waterways are to be built directly opposite those on the other side, but are to be staggered by a minimal distance of 100 feet . Any docks are to be parallel to the shoreline and one side being directly attached to land and not more than four (4) feet in width . No off-ahore tie pilings allowed beyond dock . 16. No seawalls permitted; exception may be permitted with the use of contoured seawalls to control some condition of erosion not possible to control by other methods . Such permiasion must be obtained in writing from the Grantor, his heirs or assigns . Such permission will then only be given for very limited areas. 17 . Houses to have_ a setback from the water not less than thirty (30) feet . 18. The septic tank drain field is to be located on the lot side away from the water and on the side nearest the road . • 19. Minimum lot aize will be one (1) acre. 20. In the event that the Grantee, his heirs, administrators, or assigns shall violate or - fail to carry out any or all of the covenanta , conditions , or restrictions hereinabove provided proceedings to enforce compliance therewith by injunction or other suit or otherwise may be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lots may proceed similarly . No failure or omission to bring such suit or take such other proceedings as may be deemed necessary shall be held to be a waiver of any right in the ; Grantor, his heirs or assigns, or in any lot owner to enforce compliance therewith. ; 21.
