Agreement or at ar~y other address of Debtor shorm on Secured Party'e records,
at least five~(5) days prior to such disposition~ Upon such disposition, the
proceeds thereof shall be applied to the e~cpenses of ret,aking, holding, pre-
,paring for disposition, costs of disposition including reasonable legal fees,
and then to ~he indebtedness hereby secured. Secured Party will account to
Debtor for a~y surplus~ and Debtor shall be and remain liable for any deficiency.
11. Secured Party shall have the right at all times to enforce the
provisions of this Agreement in etrict accordar~ce rvith the terms thereof, not-
withstanding any conduct or custom on its part in refraining from so doing at
any time. No ~vaiver or omission to act by Secured Party shall operate as a
waiver of a~c~y other default or of the same default at a l~ture time, and no
single or partial exercise by Secured Party of az~y right or remedy shall pre-
clude arLy other or future exercise of that or of a~y other right or remedy.
The provisions, rights and remedies hereof are cumulative and concurrent to
and ~rith those of all other agreements and documents held by Secured Party in
connection with the indebtedness herein described, Time fs of the essence of
this Agreement.
12. The term "Debtor" as used herein shall mean all parties signing this
Agreement and each of them, and such parties shall be ~ointly and severally
obligated and liable hereunder. The sfngular pronoun, Rhen used herein, shall
include the plural~ All rights of Secured Party shall inure to the benefit of
its successors and assigns; all obligations of Debtor shall-bind his heirs,
executors, administrators, successors and assigns.
ANI~ FURTHER, Debtor does hereby agree to each and every term and condition
herein, and does hereby aclmoeledge.receipt cf a cogy of this document_on this
its effective date first above set forth.~ ~
