ORDER ON PLAINTIFF'S MOTION FOR PROTECTIVE ORDER

THIS CAUSE came on for hearing this 25th day of January,
1974, upon the Motion of the Plaintiff, State of Florida,-Department
of Pollution Control, for a Protective Order, and the Court having
considered said motion, the affidavits filed in support thereof, ~

and the arguments of counsel, and it appearing to the Court that the

Defendants wish to take the oral deporsitions of PETER P. BALJET,
Executive Director; DAVID LEVIN, Chairman of the Board; W. D.
FREDERICK, JR.; ALICE C. WAINWRIGHT; JOHN ROBERT MIDDLEMAS; and
GEORGE RUPPEL, Board Members of the Department of Pollution Control,

' and the Court h3ving determined that the Defendants are entitled to
take the oral depositions of PETER P. BAWET, Executive Director of ~
i
the State of Florida, Department of Pollution Control, but it would
be an undue burden and expense to require DAVID LEVIN; W. D. FREDERICK,
JR.; ALICE C. WAINWRIGHT; JOHN ROBERT MIDDLEMAS; and GEORGE RUPPEL,
Board Members of the Department of Pollution Control, to personally
appear in Fort Pierce, Florida, for oral depositions on the subject -
matter of this case and that the Defendants' right of discovery a

would be adequately protected by written interrogatories to these
~
individuals and the Court b~ing fully advised in the premises, it

is thereupon
ORDERED AND ADJUDGED as follows:-
#1. Plaintiff's Motion for Protective Order as it applies
to Peter P. Baljet, Executive Director of the State of
Florida, Department of Pollution Control, be and the -
