HomeMy WebLinkAbout1452 12. The Grantor, his heira or asaigns reserves the right to place pipes or wires within
ten (10) feet of the boundariea of any lot, and ehall always have the right for himself, his
heirs or assigns as and when may be most convenient to him to enter on said lot for tt~e
purpoae of erecting, fixing. building, examining. maintaining or repairing such pipes,
conduits , electric lighta , telephone posts and wires , drainage pipes or awalee . and other
public services as in his opinion may be deairable or necessary to place on the ten (10)
foot etrip herein referred to; provided. however, that nothing herein shall be constructed
to permit the division of any one owner's contiguous parcel of land by auch ten (10) foot
strip, when auch contiguous parcel oonsiats of parts of more than one recorded lot.
13. All electrical and telephone service linea to individual lots shall be underground
except where those main electrical and telephone tranamission linea are located on overhead
poles running on the right of way from Gilson Road to the development proper .
14. The raiaing, maintaining or breeding of any domesticated animals or birds shall not
be permitted on the premisea; except that not more than two (2) iri number of any
apecies of household peta may be kept by the owner on the premises . Litters of dogs and/
or cats ahall be removed from the premises not more than one hundred twenty (120) days
from their birth .

15. No docks on waterways are to be built directly opposite those on the other aide,
but are to be staggered by a minimal distance of 100 feet . Any docks are to be parallel
to the shoreline and one aide being directly attached to land and not more than four (4)
• feet in width . No off-shore tie pilings allowed beyond dock .
18. No seawalls permitted; exception may be permitted with the use of contoured seawalls
to control some condition of erosion not possible to control by other methods . Such
permission must be obtained in writing from the Grantor, his heirs or asaigns. Such
permiasion will then only be given for very limited areas .
17. Houses to have a aetback from the water not leas than thirty (30) feet.

j 18. The septic tank drain field is to be located on the lot side away from the water
F and on the side nearest the road .

; 19 . Minimum lot size will be one (1) acre .

~ 20. In the event that the Grantee, his heirs, administrators, or assigns shall violate or
~ fail to carry out any or all of the covenants, conditions, or restrictions hereinabove provided,
~ proceedings to enforce compliance therewith by injunction or other suit or otherwise may
s be brought, at the option of the Grantor, his heirs or assigns. Any owner of other lots
~ may proceed similarly . No failure or omission to bring such suit or take such other
~ proceedings as may be deemed necessary shall be held to be a waiver of any right in the
~ Grantor , his heirs or assigna , or in any lot owner to enforce compliance therewith .

" 21. These covenants are to run with the land and shall be binding on all parties and on all
~ persons claiming under them until January 1, 1996.
