This Agreement made and entered into this 7th ~iay oF November
1973, by and between the State of Florida Department of Transportation,
hereinafter called the Department, Mary F. Scott and her husband,
Leslie W. Scott, hereinafter calZed the Scotts, Edgar R. Brown and -
his wife, Josephine Brown, hereinafter called the Browns, and Lake
Hamilton Citrus, Inc.,.hereinafter caZZed the Company.
T9ITNESSETH :
wHEREAS, the Department is currentZy in the process of prepar- '
ing plans on which to construct a limited access highway through a
portion of St. Lucie County, and
WHEREAS, a portion of the Brown property in St. Lucie County
consisting of approximately 7 acres will be severed and landlocked
by eonstruction of the fence on said limited access highway and
would no longer have access to this road, and
WHEREAS, the Company has had access and use of canal lying
between the Brown property and the Scott property from which-to
draw water €ar irrigation of its citrus groves, and .
WHEREAS, the continued access and use of this canal is
pertinent to the successful operation of said citrus groves, arxl
WIiEREAS, the Department has proposed to construct an access
road along the North boundary of Scotts' property in the NW-1/4 of
SW-1/4 of Section 16, Township 34 South, Range 39 East, for the
purpose of grantiny the Browns and the Company access to Indrio Road
' from their property and from said canal respectively, and
W}i~REAS, the Scotts have been contacted and found ~o be very

and the Company a~erpetual riyht of entry across their property £or
the purpose of maintainina said canal and irrigation system:
