HomeMy WebLinkAbout1429 or association in the nature of a corporation, de facto or F de jure, or a co-partnership or joint adventure by or between the Trustees and the Beneficiaries hereunder, or by or between the beneficiaries hereunder. This Declaration of Trust and Agreement shall be deemed to create only a common-law trust; and the rights and ob2igations of the beneficiar3es hereunder shall be solely those of co-owuers of the earnings, avails and proceeds of said real estate. No b~eficiary hereunder shall have any authority or right to contract for or in the name of the Trustees or anq other benefici~ry, or to bind the Trustees or any other beneficiary personally. (23) It shall be the duty of the benef icial interest holders to keep the Trustees advised in writing of their cor- ~ rect mailing addresses. (24) This Declaration of Trust and ~greement cont~ins the entire agreement between the parties hereof, and shall not ~ j be terminated or amend~d or supplemented except by another agree- ment in writing, duly executed by the Trustees then acting, ~ and by all of the then existing beneficiaries hereunder. (25) This Declaration of Trust and Agreement shall ~ for all purooses be deemed to be executed under and to be sub- ; ject to and construed in accordance witb the Laws and Statutes from time to time effective and in force in the State of Florida. (26) Copies of this Declaration of Trust and Agree- ment or any amendment or supplement thereto certif ied by the Trustees ~o be true and correct copies of the original Declara- tion of Trust and Agreement, or any amendment or supplement thereto, shall be satisfacxory evidence thereof, f or all pur- i poses.
