tions set forth in that Channel Easement Agreement, except, however,
MARINE SCIENCE CENTER, INC., by its execution of this deed, does
herewith, as to the property conveyed herein, release THE HARBOR
BRANCH FOUNDATION from all of its maintenance obligations, covenan~s,
reservations and restrictions as the grantee in that Channel Easement
Agreement; and MARINE SCIENCE CENTER, INC., does herewith agree
to fulfill and perform all of the maintenance obligations, covenants,
reservations and restrictions imposed on THE HARBOR BRANCH FOUNDATIdN
in that Channel Easement Agreement as applicable to that portion
of the channel described in this deed, and, as to that portion,
MARINE SCIENCE CENTER, INC., does herewith grant to THE HA~tBOR
BRANCH FOUNDATION all of the rights of the grantor as set forth
in that Channel Easement Agreement as it may be related to the
maintenance obligations now assumed by MARINE SCIENCE CENTER,
INC .
IN WITNESS WHEREOF, Grantor has caused this instrument
to be executed in its name by one of its Trustees and one other
person duly authorized by its Trustees, which has the same force
and effect as its execution by all of the Trustees, pursuant to the
provisions of the trust instrument.
