HomeMy WebLinkAbout2117 This conveyance is subject to the following restric- tions, conditions, covenants and reservations which are specifi- cally imposed on the land conveyed above. 1. The real property conveyed herein shall be used exclusively for marine research, scientific and educational purposes. Grantee shall not use the property for a commercial shipyard provided always that Grantee may use the property for repair, renovation, alteration or maintenance of vessels, vehicles, or equipment used in or related to the operation of its marine research, scientific and educational activities. , 2. The height of any building constructed on the ' property conveyed herein shall not exceed two stories. 3. _Grantee-shall not erect buildings or other appurtenances on more than 50$ of the property conveyed herein. 4. Grantee agrees to comply with all applicable zoning, land use, water use, air and water pollution laws, ordinances or regulations of any governmental body or agency having jurisdiction over said property. Vessels, vehicles, equipment and materiais may be ~ ' stored on the property in the open, provided such storage is i ~ E maintained in a.proper and neat manner or such storage is fenced ~ b ~ ~ from view. ~ 9 k ~ - 6. Should the Grantor, its successors or assigns, ~ ~ ~ employ counsel to successfully enforce any of the foregoing ¢ ~ ~ covenants, conditions, reser~~ations, or restrictions, by reason ~ ~ of such breach, all costs incurred in such enforcement including ~ a reasonable fee for counsel shall be paid by the Grantee, its ~ ~ ~ successors or assigns, and the Grantor, its successors or assigns ~ ~ shall have a lien upon such property to secure payment of all x `j such accounts. ~ ~ _ 7.
