parttime Employer, excluding (a) persons whose customary
workers employment is for not more than twenty (20) hours
per week; and (b) persons whose customary employ-
ment is for not more than five (5) months in any
calendar year and excludin such ersons whose
terms of em lo ent are overned b a co ective
bargaining agreement, whic a~reement does not
specifically provide for participa
on in`- this Plan.
2.09 "EMPLOYER" shall mean (a) Earl Leiffer Trucking
Co., Inc., arid (b) any parent, successor, sub-
sidiary or other business entity whose own Soard
(or similar governing body) shall duly adopt the
Plan with the approval of the Board of Directors.
2.10 "PARTICIPANT" shall mean and include all class-
. ifications as hereinafter defined:
Active (a) "Active Participant" shall mean an Employee
I Participant included in the Plan as provided under
ARTICLE III.
Deceased (b) "Deceased Participant" shall mean a Participant
Participant who has died, but whose Account has not been
fully distributed.
Retired (c) "Retired Participant" shall mean a Participant
Participant who has retired under any of the provisions of
ARTICLE VI, but whose Account has not been
fully distributed.
Vested (d) "Vested Participant" shall mean a Particip~nt
Participant who is no longer an ~nployee, but who is en-
titled to a benefit under ARTICLE VIII.
Disability 2.11 "PERMANENT DISABILITY" shall mean any physical or
defined mental condition of an Active Participant that may
reasonably be expected to be permanent and which
renders him incapable of continuing as an Employee.
In determining the nature, extent and continuation
of a Participant's disability, the Employer shall
select a competent physician to examine such
Participant and advise it with respect to such
disability. The final determination shall be made
by the Employer on the basis of such evidence.
